The record reflects that on October 21, 1992, the victim, Deron Haynes, was a passenger in a car driven by his brother Craig. Following a collision with another vehicle, Craig left the scene of the accident.
On the afternoon of October 22, Phillip Secret and some others angrily confronted Deron about the accident, at which time Deron told him that he had not been the driver of the car involved in the accident. One of the others present, Jermaine Cole, testified that Deron pulled a gun during the confrontation. Phillip and the others next stopped at Phillip's house, from which he emerged carrying a blue nylon gym back containing a shotgun. The group then began searching for Deron on the streets and at his trailer home. A second confrontation took place at a parking lot and ended when Jermaine pointed a gun at the car in which Deron was riding. At some point, following this last confrontation, Deron went to his trailer home.
Gregory Pool testified that he encountered Phillip around 9:30 PM on October 22. Gregory stated that Phillip told him, Anthony Cates, and Jeron Dean that "a guy pulled a gun on him and he wanted to get this shit out and go scare his ass." He stated that shortly thereafter, he Anthony, and Jeron drove to Phillip's house and Phillip got in the car with them carrying the blue bag. Gregory testified that he looked in the bag and saw a shotgun and a .22-caliber revolver.
The group then drove to Leonard Anderson's house where Phillip went inside for a few minutes with the blue bag. Phillip returned to the car with Leonard. Gregory testified that the blue bag now also contained an AK-47. Gregory stated that he could not recall any specific conversation by the group as Anthony drove them to Deron's trailer beyond the fact that "we was just excited to shoot the guns off basically."
After arriving at the trailer court, they met up with a group of men in a second car. Gregory said that the second group of men had earlier been told by Phillip, referring to Deron, to "go scare this fool. If he pulls a gun on me, he can't be doing that." Deron's trailer was located apparently by reference to the damaged car in front. Gregory stated that they drove by the trailer at about 10 MPH. He testified that there were lights on in the trailer and that "some guy peeked out the door." Gregory stated that he said aloud "somebody's up in there." Gregory testified that both cars were parking in parking lots close to the trailer court. He testified that Phillip, stating "shoot these mother fuckers," handed the shotgun to Anthony, the .22 revolver to Gregory and the AK-47 to Jeron. Leonard had his own gun, a .380 semiautomatic.
The group, which now numbered seven, was given directions by Phillip. In response, Gregory and Jeron went to the front of the trailer. Gregory testified that he saw Leonard standing toward the end of the trailer in the back. Keith Williams, who drove the second carload of men, testified that the trailer was surrounded and that he saw Leonard firing his gun around the window area. Keith stated that he did not hear Leonard encourage anyone to shoot or direct anyone to do anything. Gregory stated that he shot his gun toward the top front of the trailer. He testified that he then began running away from the trailer, that he could still hear shots being fired, and that "it sounded like war or something."
Twenty-four bullet holes, identified as coming from the AK-47 used by Jeron, were found on the front of the trailer. Twenty-two of those bullets went into the skirt of the trailer and two went into the living area of the trailer, one of which fatally wounded Deron Haynes.
