The charges against Paul and Jennifer Gillpatrick stem from the death of Robby Robinson in the early morning hours of August 29, 2009.  Robby was at his apartment with friends when three individuals came to the apartment and shot Robby to death.  

The State's key witness at trial was Eric Gillpatrick, Paul's brother.  Eric testified that the three individuals who went to Robby's apartment the night of the shooting were he, Paul and their sister, Jennifer.  Eric testified that on that night, Jennifer went to Robby's apartment to obtain methamphetamine for him.  After Jennifer had been gone for awhile, she called Eric and Paul and told them that someone at Robby's apartment had "roughed her up."  

Paul and Jennifer developed a plan to go back to Robby's apartment.  Eric followed them there in his own vehicle.  Once Eric arrived at the apartment, Paul and Jennifer were already at Robby's door.  Eric started to go up the stairs leading to Robby's apartment but he heard gunshots and ran back to his vehicle.  When he looked back, he saw Paul and Jennifer running down the stairs.  Later, Paul admitted to Eric that he had fired the shots and that he had then disposed of the weapo
