On January 29, 2001, Elmore Hudson and Derrick Jones broke into the apartment of Victor Rodriguez and his girlfriend, Margarite Salgado, in Omaha, with the intent to steal money and drugs.  Derrick kicked down the door to the apartment.  Elmore began repeatedly striking Victor in the back of the head with a wooden softball bat that he brought with him.  After punching Margarite in the face several times, Derrick began searching the apartment for money and marijuana while Elmore began hitting Margarite with the bat.  

When Elmore and Derrick left the apartment, Victor and Margarite were apparently unconscious.  Margarite apparently regained consciousness and was able to go for help.  

Both Margarite and Victor were taken to St. Joseph hospital.  Victor sustained traumatic brain injury and was in a coma.  He had a large laceration to the left frontal part of his scalp, exposing the bone, among other lacerations.  When admitted to the hospital, Victor had a 30% chance of death.  He was restless, incoherent, not able to follow or respond to simple commands, speaking only infrequently, not capable of symmetrical eye movement, unable to walk without substantial assistance, and required 24-hour a day assistance.  Victor eventually died due to his brain injuries.
