Forrest W. Hurlburt was charged with two counts of 2nd degree murder - the murder of Allen Thingstad and the murder of Matthew Meisinger. He claimed the killings were done in self-defense.
Forrest and a group of co-workers got off work early on the morning of September 11, 1982, and proceeded to a bar in Louisville where Forrest met Lisa Owen and several other friends. Allen and Matthew were also in the bar. While Forrest and others were playing pool in the bar, Allen approached the pool table and made rude comments to Lisa Owen. Allen also challenged the male members of Forrest's party to a fight, an offer which was declined. Allen then went to a table occupied by two girls, Cathy and Becky, where he dropped his pants.
Lisa, Forrest and friends left the bar and the bar owner escorted Allen outside. Shortly after he left the bar, Forrest obtained a .25 auto pistol from one of his group. Lynn Kellogg, a member of the Forrest group, heart Forrest say that the "big guy" (Allen) was not going to jump on his back. As they were leaving the bar, Allen and Matthew approached Forrest's group and Allen said "which one of you guys would like to go in this vacant lot with us and get it on?" Although the Forrest group started to leave, Forrest returned downtown to locate one of his friends, Roger Hassebroek.
Forrest had explained to Lisa that the gun was for her protection; he did not want to shoot anyone, he did not want to go to the pen, but he was not leaving until Roger was out of the downtown area safely. Forrest and Lisa got out of the car and shortly afterward. Allen, also known as "animal" began chasing Lisa around Forrest's car. After Allen failed to catch Lisa, Forrest attempted to get into his car and leave. However, Forrest was restrained by Matthew, who said, "You aint' going nowhere. The big one (Allen) wants to talk to you."
In the conversation that followed between Forrest and Allen, Forrest told Allen he could get an after-hours drink down the street. Allen replied, "If you're lying to me, you're a dead man." Forrest was again attempting to get into his car when someone struck him from behind and caused him to spin around. Forrest believed he saw someone holding a knife over his head. Forrest, who had been carrying the gun in plain view, fired one shot, fatally striking Matthew in the heart. Someone yelled "kill that mother fucker" and Forrest saw Allen advancing toward him in a menacing manner. Forrest backpedaled as fast as he could as Allen ran toward him with his left arm extended, his fingers spread apart, and his right arm at his side with his fist clenched. At Allen's contact, Forrest fired, striking Allen in the heart and causing his death. Forrest immediately left the scene of the shooting, but returned soon to turn himself into the police.
