After 9 PM on October 4, 1997, Matthew Jackson and Phillip Caudell, Jr., were at Jake's Mini Mart located at 8320 Blondo Street in Omaha.  Matthew used a pay phone to call a taxi and the owner of the business adjacent to the mini mart testified that he overheard two men discussing that their cab would take 20 to 30 minutes to arrive.  Matthew and Phillip sat down outside the mini mart to wait.  

When Christopher Knapp and James Haseltine exited the mini mart, they apparently made eye contact with Matthew and Phillip.  Matthew stated that he was asked by either Christopher or James what he was looking at.  Matthew replied "What are you looking at?"  Matthew testified that a verbal exchange occurred between Phillip and the other man.  

Christopher and James crossed the street, heading south, and stopped.  Matthew said that one of the two men turned and yelled, "If you want to talk shit, come over here and talk shit, you wetback."  Matthew stated that Phillip immediately got up and started walking across the street toward Christopher and James.  Matthew followed Phillip.  Matthew claimed he was behind Phillip when Phillip and Christopher began fighting.  Matthew ran up to Phillip, intending to break up the fight, but was shoved by James.  Believing he was being attacked, Matthew Jackson hit James three times in quick succession, and James fell down.  

After Christopher and James had been beaten and knocked to the ground, Matthew and Phillip jogged back across the street to pick up their purchases which they left outside the mini mart.  The two men returned to Phillip's apartment and called someone to come and get them.  Jennifer McGann, a passenger in the car that picked up Phillip and Matthew testified that Matthew informed her that he and Phillip had been in a fight.  

Later at a party, Matthew bragged about the fight and stated that the victims had not had a chance to get their fists up.  He said that he had kicked one of them and he had blood on his hands and socks.  Matthew explained that words and looks had been exchanged and Phillip just walked up and started beating them.  

Christopher and James were taken to a hospital.  While in the ER, James suffered a seizure and was hospitalized for several days.  Christopher's condition was critical.  He had external injuries caused by separate blunt traumas and internal head injuries.  He did not regain consciousness and died a couple of weeks later.
