On August 5, 1976, Lela Partee, wife of Roosevelt Partee, died in her home as a result of a brutal beating. At approximately 2:30 AM, a rescue squad and police were called to the home, apparently by Roosevelt. Roosevelt told police that he had been sleeping and awoke to find his wife lying in a pool of blood. He stated that he went to his daughter's home to call an ambulance.
Lela was dead when the police arrived, although rigor morits had not yet set in and the body was cool. The evidence shows that Roosevelt had beaten Lela on more than one occasion in the months preceding her death. One such beating had occurred on July 30, 1976, six days before the crime herein, and as a result, Lela required emergency treatment at a hospital.
Flora Phillips, a friend of Roosevelts, testified that she had seen Roosevelt on his front porch at approximately 10:15 PM on the night of the crime. He was wearing a white t-shirt which was bloody, and she observed him tearing the shirt off and throwing it on the porch. Police found the shirt when they arrived on the scene. The shirt was damp with bloodstains, the buttons were ripped off.
