On the morning of January 1, 1977, Rachael Pass was found dead in the bedroom of her apartment with multiple stab wounds on her body and throat.
Two of her children, who were 6 and 7 years of age, testified they had awakened the previous night when they heard their mother screaming, and they heard her cry out "stop Tommie," at one point. One of the children identified Thomas Freeman as being in the apartment at the same time, and testified she saw Thomas pass her room to go to the kitchen and returned carrying a knife.
A search of Thomas's apartment disclosed a shirt, jeans, shoes and gloves containing bloodstains. The blood matched Rachael's blood grouping and Rh factor. Also, hairs similar to Rachael's were found in the gloves. Police also found a fresh wound or cut on Thomas's hand.
Thomas, a boyfriend of Rachael's, told police that he had visited her in the early morning of January 1 for a short time but had left. Then he stated he returned to the apartment and found her dead, panicked and left.
