The main evidence against Rodney Mason in regards to the April 6, 2003, shooting death of Sergio King: Three eye witnesses (Nicole Wagey, Prentice Mason, and Lolester Mitchell). Prentice is Rodney's brother.
Nicole and Prentice were in the car with Rodney and Sergio when Rodney shot Sergio. Lolester testified that he was in another car when he saw Sergio exiting Nicole's car and saw Sergio shot by someone from inside Nicole's car.
Nicole testified that she was at a party at Prentice's house on the night of April 5, 2003. Rodney was also at the party. Rodney and some other individuals spent the night at Nicole's apartment.
On the morning of April 6, Nicole decided to obtain some weed and contacted Sergio whom she had previously bought weed from. Nicole and Rodney picked up Prentice on the way to meeting Sergio. Rodney rode in the front passenger seat of Nicole's car, and Prentice rode in the passenger's side back seat. Nicole drove to a location where they met Sergio. Another person was in the car with Sergio. Sergio did not want to stay at that location because it was near a police substation, so they drove both cars to some other locations until they arrived at the place chosen by Sergio.
Sergio got out of his car and got into the driver's side back seat of Nicole's car. The parties in the car had a conversation regarding the purchase of weed, and eventually the conversation turned to a discussion of purchasing crack cocaine. At one point, Rodney pulled out a gun and told Sergio "break yourself." Rodney then fired a shot at Sergio and Nicole noticed blood on Sergio's hand. Sergio got out of Nicole's car and ran toward his car, and Nicole drove away. Nicole did not recall hearing or seeing a second shot. She testified that she did not know Rodney was going to shoot Sergio.
